Terms of Use

By using BaytiChef, you agree to these Terms of Use, to use the service lawfully, and to provide accurate account, order, chef, payout, and support information.
BaytiChef Platform Role
- BaytiChef provides a technology marketplace that helps customers discover, order, and pay for meals offered by independent chefs.
- BaytiChef is not the chef, food producer, seller, caterer, restaurant, delivery provider, health authority, or insurer for meals listed by chefs unless BaytiChef expressly states otherwise in writing.
- Chefs act as independent providers and are not employees, agents, partners, franchisees, or legal representatives of BaytiChef.
- BaytiChef may facilitate listings, payments, messaging, support, reviews, refunds, compliance checks, and operational controls, but this does not transfer a chef's legal responsibility for their food or business operations to BaytiChef.
Chef Legal Responsibility
- Chefs are solely responsible for the meals they list, prepare, package, label, store, sell, and hand over through or outside the platform.
- Chefs must comply with all applicable food-safety, hygiene, licensing, permit, tax, consumer-protection, labeling, allergen, health, delivery, and business-registration rules in their market.
- Chefs are responsible for truthful menu descriptions, ingredient information, allergen disclosures, portion details, availability, pricing, photos, pickup or delivery readiness, and any required food warnings.
- Chefs are legally responsible for illness, contamination, allergic reactions, injury, mislabeling, unsafe food handling, unlawful sales, permit failures, tax failures, customer disputes, or other claims arising from their meals, kitchen, staff, contractors, packaging, fulfillment, or business conduct.
- Chefs must keep any required permits, inspection records, food-handling records, tax records, and insurance current and provide evidence to BaytiChef on request.
- Chefs agree to indemnify and hold BaytiChef, its owners, officers, employees, contractors, service providers, and affiliates harmless from claims, losses, penalties, damages, costs, and legal fees arising from the chef's food, listings, legal compliance, customer interactions, or breach of these terms.
Customer Responsibility
- Customers are responsible for reviewing meal descriptions, ingredients, allergen notes, prices, quantities, dates, fulfillment method, address, contact details, and order selections before placing an order.
- Customers with allergies, dietary restrictions, medical conditions, religious requirements, or special handling needs must confirm suitability directly through the information provided and should not order when the information is unclear.
- Customers must use the platform lawfully and must not abuse chefs, support channels, payment systems, promotions, reviews, refunds, or marketplace features.
Orders, Payments, Cancellations, and Refunds
- Availability, pricing, promotions, delivery options, and fulfillment windows may change before an order is confirmed.
- Orders are subject to chef acceptance, payment authorization or capture, capacity, fraud checks, delivery feasibility, and platform rules shown in the active checkout flow.
- Payments, payout timing, authorizations, captures, reversals, cancellations, refunds, service fees, delivery fees, taxes, and disputes follow the active checkout, payment-provider, and support policies.
- BaytiChef may cancel, refuse, refund, suspend, withhold payout, reverse transfer, or adjust an order where required for safety, fraud prevention, legal compliance, operational issues, payment-provider rules, or violation of these terms.
Platform Protection and Enforcement
- BaytiChef may review, approve, reject, hide, edit, limit, suspend, or remove accounts, chef applications, meals, photos, reviews, messages, promotions, payouts, and transactions to protect users, the platform, payment systems, legal compliance, and marketplace quality.
- BaytiChef may request identity, business, food-safety, payout, tax, address, order, or compliance information from chefs and may pause access or payouts until the information is provided and verified.
- BaytiChef may cooperate with regulators, law enforcement, payment providers, delivery providers, hosting providers, insurers, and legal advisers where needed for compliance, claims, investigations, safety, fraud prevention, or enforcement.
- Users may not scrape, copy, reverse engineer, disrupt, overload, resell, impersonate, bypass security, upload harmful code, or use BaytiChef for unlawful, misleading, abusive, fraudulent, or infringing activity.
Content and Intellectual Property
- BaytiChef owns or licenses its brand, design, software, platform content, workflows, and service materials.
- Users keep ownership of content they submit, but grant BaytiChef a worldwide, royalty-free license to host, display, adapt, translate, moderate, promote, and use that content to operate and market the platform.
- Users must only upload content they have the right to use and are responsible for any claims arising from their submitted text, photos, names, logos, menus, or other materials.
Disclaimers and Liability Limits
- BaytiChef provides the platform on an "as is" and "as available" basis and does not guarantee uninterrupted access, error-free operation, continuous availability, chef performance, meal quality, ingredient accuracy, delivery timing, customer conduct, or regulatory approval of any chef.
- To the maximum extent permitted by law, BaytiChef is not liable for indirect, incidental, special, consequential, punitive, lost-profit, reputational, food-related, allergy-related, health-related, chef-operation, delivery-provider, payment-provider, or third-party damages.
- Nothing in these terms excludes liability that cannot be excluded under applicable law.
